OUTREC Inc., a Delaware corporation (“OUTREC”, “we”, “our”, or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.
Our Commitment to Privacy
This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit our websites and applications that link to or otherwise reference this Privacy Policy (the collectively, the "Services"). We take your privacy very seriously. To better protect your privacy, OUTREC provides this Privacy Policy explaining our information practices and the choices you can make about the way your information is collected and used and describes how you can access and update this information.
This Privacy Policy applies to information we collect: (1) through the Services; and (2) in email, text, and other electronic messages between you and the Services. It does not apply to information collected by: (1) us offline or through any other means, including on any other website operated by OUTREC that does not reference this Privacy Policy (including our affiliates and subsidiaries); or (2) any third party, including through any application or content that may link to or be accessible from or on the Services.
Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using the Services, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 18
THE SERVICES ARE NOT INTENDED FOR CHILDREN UNDER 18 YEARS OF AGE.
No one under the age of 18 may provide any information to or on the Services.
We do not knowingly collect or maintain personally identifying information from anyone under the age of 18. If you are under 18, do not use or provide any information on the Services or through any of its features or provide any information about yourself to us, including your name, address, telephone number, email address, vehicle identification number or any screen name or username you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at the contact information above.
Information We Collect
We may collect several types of information from and about users of our Services, including information: (1) by which you may be personally identified, such as name, postal address, e-mail address, telephone number, license plate number, vehicle identification number, or any other identifier which is deemed personal information under various laws, rules, and regulations applicable to this Privacy Policy ("personal information"); (2) that is about you but individually does not identify you; and (3) about your internet connection, the equipment you use to access the Services, and usage details. We collect this information (i) directly from you when you provide it to us; and (ii) automatically as you navigate through the Services. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
Information You Provide to Us
The information we collect on or through the Services includes information that you provide by filling in forms through the Services, which includes information provided at the time of registering to use our Services, subscribing to our service, or contacting us through the Services, including without limit:
• Account Information, such as your name, email address, and password;
• Profile data and other information necessary to create a profile to use certain features of the Services which may include without limit, street address, phone number, driver's license number, date of issuance and issuing county and/or state, profile photos, employer, city, school, biography, and date of birth;
• Vehicle data such as vehicle listing details, vehicle identification number or serial number, as applicable, availability dates, reviews, and uploaded trip photos;
• Payment data such as bank account or card numbers, and transaction information in connection with a potential or actual transaction;
• Identify verification data such as a photograph, driver's license copy, passport, national ID card, last four of your Social Security, social insurance number, social media account information, driving/motor vehicle record, insurance information, or other identification forms; and
• Any additional information provided that we may ask for if you report a problem with our Services or otherwise communicate with us, such as copies of your correspondence; and
• You search queries and other details of your transaction you carry out through the Services.
You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Services, or transmitted to other users of the Service or third parties (collectively, "User Contributions").
Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including, without limitation:
• Usage data, such as the pages or other content you view, searches, bookings, time spent on a page or screen, sites from which you link or browse to in the Services, navigation paths between pages or screens, information about your activity on a page or screen, access time, duration of access, and other actions on the Services;
• Location data such as approximate location (e.g., city/town associated with your IP address, including geolocation), provided if you opt in to use location sharing, we may collect the precise location information of your mobile device;
• In-vehicle data and recordings to the extent an OUTREC recording device is installed, including without limitation, GPS location, driving behavior, videos, pictures, and audio recordings;
• Device data such as the computer or mobile device used to access or use the Services, including operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, unique device identifiers, or general location information such as city, state, or geographic area; and
• Trip data such as transactional information related to the trips you take through the Services, including the data and time of your trip, amounts charged, and other related trip details.
We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services. The information we collect automatically may include personal information, but we maintain it or associate it with personal information we collect directly from you. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to: (1) estimate our audience size and usage patterns; (2) store information about your preferences, allowing us to customize our Services according to your individual interests; (3) speed up your searches; and (4) recognize you when you return to access the Services.
The technologies we use for this automatic data collection may include cookies, web beacons, tags and scripts and are used by us and analytics providers. These technologies are used in analyzing trends, administering the Services, tracking users' movements around the Services and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies.
Cookies (or mobile/flash cookies)
A cookie is a small file placed on the hard drive of your computer, phone, or other device. You may refuse to accept browser cookies by activating the appropriate setting on your equipment and changing your cookie settings in your browser. However, if you select this setting you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you use the Services.
Web Beacons
The Services and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website or application statistics.
Log Files
As is true of most websites and applications, we may use gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We do link this automatically collected data to other information we collect about you.
Analytics Service Providers
• We may use Google Analytics, or other analytic providers, to help us understand how our users utilize the Services.  You can read more about how Google uses your personal information or opt out of Google Analytics here: https://www.google.com/intl/en/policies/privacy/.
• We may use Hotjar, or other service providers, to provide us heatmapping and/or session recording services while you utilize the Service. This data is collected anonymously in an aggregated view. OUTREC Recording Device
If a vehicle has an OUTREC recording device installed, we may remotely collect certain information about the vehicle and your driving behaviors through video recording, pictures, and/or audio recordings. We may utilize a third party service provider to provide such services. We may use this data as necessary to determine liability under an insurance claim and provide such information to hosts and insurance providers to assist in their investigation of any claim. Upon the written consent between a host and guest, OUTREC may provide such information to hosts to be utilized for its marketing campaigns. OUTREC assumes no liability, and each host and guest hereby expressly release OUTREC from any responsibility or liability arising from or in any way related to the provision of any such videos, pictures, or audio recordings to a host upon receipt of written consent from a guest. You hereby acknowledge that any agreement related to the host’s use of any videos, pictures, or audio recordings is between a guest and host and OUTREC has no responsibility, liability, or obligation resulting therefrom. As between OUTREC and Users, guest assumes all risk and liability related to providing any such consent.
Third Party Use of Cookies and Other Tracking Technologies
Some content or applications, including advertisements, on the Service are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. OUTREC may use Facebook Pixel, or similar providers, to provide you with interest-based (behavioral) advertising or other targeted content. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Service. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services.
We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information: (1) to present our Services and its contents to you; (2) to provide you with information, products, or services that may be of interest to you; (3) to fulfill any other purpose for which you provide it; (4) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection and customer service; (5) to notify you about changes to our Services or any products or services we offer or provide through it; (6) allow you to participate with interactive features on our Services, including communication with other users; (7) in any other way we may describe when you provide the information; (8) to administer referral programs, rewards, surveys, contests, or other promotional activities or sponsored events in which you participate; (9) for any other purpose with your consent; (10) to verify your identity or authenticate information; (11) resolve disputes, including making insurance claims or to identify unsafe driving behavior; and (12) to comply with applicable laws, lawful requests, and legal processes, such as to respond to subpoenas or requests from government authorities as we believe necessary or appropriate as determined in our sole discretion.

Finally, we never use, share, sell or rent the personal information provided to us online in ways unrelated to the ones described in this Privacy Policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Behavioral Advertising

We may contract with third party advertising and social media companies to display ads on the Services and other sites. These companies may use cookies and similar technologies to collect information about you (including the device data, online activity data, and/or geolocation data described above) over time across our Services and other sites and services or your interaction with our emails, and use that information to serve ads that they think will interest you. These ads are known as “interest-based advertisements”
We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Do Not Track and Location Sharing

When you opt in to use our location sharing feature, we may collect the precise location information of your mobile device. Keep in mind that most mobile devices allow you to control or disable the use of location services by any application on your mobile device in the device’s settings menu.

At this time, we do not respond to browser ‘Do-Not-Track’ signals.

Marketing Materials

You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email. You may continue to receive service-related and other non-marketing emails. If you receive marketing text messages from us, you may opt out of receiving further marketing text messages from us by replying STOP to our marketing message or as described in the message.
If you wish to close your account and request deletion of your personal information, please send an email to privacy@outrec.com.
Please note that we may be unable to delete information needed to comply with applicable laws, detect or prevent fraud, collect any fees owed, resolve disputes, assist with or process claims, troubleshoot problems, assist with any audits and investigations, to enforce our Terms of Use and this Privacy Policy, and take other actions reasonably necessary, permitted, or required by applicable law. There may also be residual information that will remain within our databases and other records, which will not be removed.
Interest-Based Advertising Choices
Your choices for limiting use of your personal information for interest-based advertising include:
Blocking cookies in your browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit www.allaboutcookies.org.
Blocking advertising ID use in your mobile settings. Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device (e.g., Apple ID for Advertising or Google Advertising ID) for interest-based advertising purposes.
Using privacy plug-ins or browsers. You can block sites from setting cookies for interest-based ads by using a browser with privacy features, or installing browser plugins, and configuring them to block third party cookies/trackers.
Advertising industry opt-out tools. You can also use these opt-out options to limit use of your information for interest-based advertising by participating companies (but note we may work with companies that do not participate in these programs):
Location data
Users of our mobile application can disable the application’s access to the device’s location within the device’s settings, however, if a vehicle has an OUTREC recording device installed, we may remotely collect certain information about the vehicle and your driving behaviors through video recording, pictures, and/or audio recordings. We may utilize a third party service provider to provide such services. Please see section titled “OUTREC Recording Device” above for more information.
Third-party platforms and social media networks
If you choose to connect the Services to a third-party platform or social media network, such as by using the third party’s authentication service to log into your account on the Services, you may be able to control your settings through the third-party platform or social media network. If you withdraw our ability to access certain information from a third-party platform or social media network, that choice will not apply to information that we have already received from that third party.
Personal Information Collected from Third Parties
If you choose to log in to our Services through a third-party site or service (e.g., Apple, Facebook, or Google), the third-party service may send us information such as your registration and profile information from that service. The information we may receive varies by service and is controlled by the relevant service. By associating an account managed by a third party with your account and authorizing us to have access to this information, you consent to the collection, storage, and use of this information procured in accordance with this Privacy Policy. We do not control the third parties use and disclosure of your information and encourage you to refer to the privacy policies of those third parties to understand how they use and disclosure your personal information.
To the extent permitted by applicable laws, we may collect background information about you from public records, background check providers, or other screening services, including without limitation, credit reports, driving records and information about criminal convictions or from sex offender registries. We may use your information, including your full name and date of birth, to obtain such reports.
To the extent permitted by applicable law, we may receive additional information about you, such as demographic data, fraud detection information, or data from credit bureaus and other third-party data providers.
We may combine the information about you that we receive from third-party sources with other information we have about you.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this Privacy Policy: (1) to our subsidiaries and affiliates; (2) to contractors, service providers, and other third parties we use to support our business, including without limitation, to our insurance providers; (3) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the OUTREC's assets and any preliminary negotiations and diligence thereto, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by OUTREC about our Service users is among the assets transferred; (4) to fulfill the purpose for which you provide it; (5) for any other purpose disclosed by us when you provide the information; or (6) with your consent.
We may also disclose your personal information: (1) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (2) to enforce or apply our terms of use and other agreements, including for billing and collection purposes; or (3) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of OUTREC, our users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. We may also disclose your information in response to valid legal requests relating to criminal investigations or alleged or suspected illegal activity or any other activity that may expose OUTREC, you, or any other user, or to protect the rights, property, or personal safety of OUTREC, our users, or others.
We never use, share, sell or rent the personal information provided to us online in ways unrelated to the ones described in this Privacy Policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.
Service-Related Announcements
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature.
Links to Other Sites
The Services may contain links to other sites that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such third party sites. We encourage you to read the privacy policies of each and every website that collects personal information.
Service Providers
We use other third party service providers, such as financial processing service providers to store payment information and process payments made on or through the Services. You will be required to provide financial information before conducting any transaction through the Services. When you sign up for our Services, we will share your personal information only as necessary for the third party to provide that service on our behalf.
Business Transitions
In the event OUTREC goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal information will likely be among the assets transferred.
Our Commitment to Data Security
The security of your personal information is important to us. We have implemented an information security program that contains administrative, technical and physical controls that are designed to reasonably safeguard personal information.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services and messaging between users. The information you share in public areas may be viewed by any user of the Service.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in the Services.
Changes to This Policy
We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice to the Services prior to the change becoming effective. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically review this Privacy Policy to check for any changes.
How You Can Access, Correct, Delete and Deactivate Your Information
You can access, review and change, or delete your personal information by logging into the Service and visiting your account profile page.
You may also send us an email at privacy@outrec.com to request access to, correct or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other users.
We will retain your information for as long as your account is active or as needed to provide you services. If you wish that we no longer use your information to provide you services, contact us at privacy@outrec.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We use this procedure to better safeguard your information. You can correct factual errors in your personal information by sending us a request that credibly shows errors. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.
California Privacy Rights
California Civil Code Section 1798.83 and the California Consumer Privacy Act of 2018 entitle California users to request information concerning the disclosure of certain personal information to third parties. While you can always contact us at privacy@outrec.com with any questions, please know we do not currently sell data trigging these statutes. However, like many companies online, we use services provided by Google, Facebook, and others that help deliver interest-based ads to you as described in the section above entitled Interest-based advertising. We describe how you can opt-out of use of your Personal Information for interest-based advertising in the section entitled Interest-based advertising choices
Nevada Privacy Rights
Nevada Revised Statutes Chapter 603A entitle Nevada users to certain opt-out rights. While you can always contact us at privacy@outrec.com with any questions, please know we do not currently sell data trigging that statute's opt-out requirements.
